Not legal, financial or investment advice
All content on prepatent.org, including articles, guides, the glossary, the patent history timeline, quizzes, the invention readiness check and downloadable materials, is provided for general educational and informational purposes only.
It is not:
- legal advice, including advice on patentability, patent drafting, filing strategy, validity, infringement, licensing contracts or litigation;
- financial or accounting advice, including advice on valuation, tax or company structure;
- investment advice, or a recommendation to buy, sell or hold any security, invest in any company, or enter into any transaction.
Every invention, business and market is different, and the law differs from country to country. General information cannot take the place of advice tailored to your facts.
No attorney-client relationship
The site owner is a retired businessman and inventor, not a lawyer or registered patent attorney or agent. Reading this site, sending us a message, using the contact form, or buying a consultation or digital product does not create an attorney-client, patent agent-client or other professional fiduciary relationship.
Our consulting services are business and strategy guidance. They do not replace a registered patent attorney or agent, a lawyer, an accountant or a licensed financial adviser.
Do not send confidential invention details through the public contact form or ordinary email before confidentiality terms have been agreed. Communications with us are not protected by legal professional privilege.
Opinions and perspective
Much of this site is commentary. We discuss how patent systems have developed, from the Venetian Patent Statute of 1474 to modern laws such as the America Invents Act of 2011, and how these systems affect independent inventors and smaller companies.
Statements about government bodies (such as patent offices and the Patent Trial and Appeal Board), legislation, courts, industries and named companies represent the site’s perspective, analysis and opinion. They are offered in good faith to encourage discussion and better decisions. They are not statements of fact about the motives or conduct of any person or organization, and they are not intended to disparage anyone. Reasonable people, including experienced practitioners, may disagree.
If you believe something we have written about an institution or company is factually wrong, please tell us. We will review it and correct it where appropriate, as described in our Editorial Policy.
Accuracy and timeliness
We work to make our content accurate and to base factual statements on reliable sources such as statutes and official patent office publications. However:
- patent laws, rules, fees, deadlines and procedures change, sometimes with little notice;
- court decisions can change how laws are applied;
- articles reflect the information available when they were written or last updated; and
- historical accounts may simplify complex events.
We do not warrant that any content is complete, current or error-free. Always check deadlines and requirements with the relevant official office, such as the USPTO, CIPO, the EPO or WIPO, and with a qualified professional.
Results are not guaranteed
Commercializing an invention is uncertain. Many patents never earn back what they cost, and outcomes depend on the technology, the market, timing, funding, partners and many other factors outside anyone’s control.
We do not promise or guarantee that using our content, tools or services will lead to any particular result, including:
- obtaining or enforcing a patent;
- finding, attracting or closing a deal with a partner, licensee or investor;
- achieving any valuation, revenue or profit; or
- avoiding infringement, piracy or disputes.
Scores and suggestions from interactive tools on the site are simple self-assessment aids. They are not evaluations of your invention by a professional.
External links
We link to external websites, such as patent offices, legislation, reference works, related sites and our sponsor’s website, because they may be useful to you. We do not control these sites and are not responsible for their content, accuracy, availability, security or privacy practices. A link is not an endorsement of everything on the linked site. Visiting external sites is at your own risk and subject to their terms.
When to seek professional advice
Please consult qualified professionals before acting on anything you read here, especially:
- before publicly disclosing, demonstrating, selling or offering an invention, since disclosure can affect patent rights;
- before filing, or deciding not to file, a patent application;
- before signing an NDA, license, assignment, joint venture or investment agreement;
- before making significant financial or investment decisions; and
- whenever you are facing an infringement claim, a challenge to your patent, or a deadline.
A registered patent attorney or agent, a business lawyer, and a qualified accountant or financial adviser in your jurisdiction can advise on your specific situation.
Sponsor and affiliate disclosure
This site is sponsored by Superior Hulls Inc. (Canada/Israel), a corporation working on maritime innovation, including the use of air injected under ship hulls. You can learn more on its website, superiorhulls.com.
Because of this sponsorship, readers should be aware that:
- some articles, including our article on air lubrication and ship hulls, discuss a field in which the sponsor is active;
- the sponsor’s search for a major maritime partner is an example of the pre-partnering approach this site describes; and
- references to the sponsor are disclosures of a relationship, not independent reviews.
We sell our own consulting services and digital products through the shop. If a page ever includes affiliate links or paid placements from anyone else, we will disclose that clearly on the page.
Testimonials
We do not currently publish client testimonials, reviews or case results on this site. If we publish any in the future, they will be genuine, will reflect the honest experience of the person quoted, will disclose any material connection with us, and will not imply that other people will achieve the same results.
Errors and omissions
Despite our care, the site may contain typographical errors, inaccuracies or omissions, including in product descriptions and prices. We reserve the right to correct errors and to update information at any time without prior notice. To the fullest extent permitted by law, we are not liable for any loss or damage arising from reliance on information on the site. See the limitation of liability section of our Terms & Conditions.
If you notice an error, please let us know. We appreciate corrections from readers.
Fair use and quoted material
This site may quote short passages from statutes, official publications, books, articles and speeches, and may reproduce historical patent drawings and documents. We do so for commentary, criticism, education, research and news reporting, with attribution where possible. We believe such use is permitted under the fair use doctrine of United States law (17 U.S.C. §107), fair dealing provisions in countries such as Canada, the UK and Israel, and similar exceptions elsewhere, or under the license or public-domain status of the material.
